Deborah Fabricant has practiced litigation for her entire seventeen year legal career, in New York City as a partner in a highly respected litigation boutique specializing in complex business litigation and for the last nine years in Southern California.  She has extensive litigation experience in ERISA and employee benefit matters, and has served as litigation counsel to employers, plans, insurance companies, fiduciaries, including specially appointed fiduciaries (for litigation purposes), participants and beneficiaries.

 

 Ms. Fabricant’s experience is diverse.  She was involved as lead counsel on behalf of a group of employer’s who challenged the constitutionality of the Multiemployer Pension Plan Amendments Act of 1980, when it was first enacted and has defended, at the administrative level, and in arbitration, withdrawal liability claims on behalf of employers.  She has litigated through trial, in both federal and state court, benefit claims, both on behalf of plans and employers and on behalf of participants/beneficiaries and is experienced in fiduciary litigation as well.

 

 Ms. Fabricant has advised and counseled non-ERISA attorneys and other professionals, and served as an expert, regarding ERISA aspects of non-ERISA litigation, including preemption, fiduciary responsibility, discriminatory discharge or retaliation under ERISA, subrogation rights of insurers and the like.

 

 Ms. Fabricant is also experienced in general business litigation and has litigated antitrust, unfair competition and environmental matters.

 

Ms. Fabricant received her undergraduate degree from Barnard College (Columbia University), cum laude in 1974.  She obtained her law degree from New York University in 1979 where she graduated Order of the Coif.  She is an active member of the American Bar Association, the California Bar Association, and the Orange County Bar Association for which she serves on the Judiciary Committee.  She serves on the Board of Directors of the Legal Aid Society of Orange County and is a member of the Orange County Superior Court Mediation Panel.
