ERISA law is very complex, requiring attorneys to achieve superior technical knowledge in order to have be successful in claims and disputes.  Our attorneys have decades of experience in representing clients in ERISA matters, which is a key component in resolving your matters effectively and

efficiently.  In ERISA litigation matters, we represent employers and other plan sponsors, fiduciaries, plan service providers (i.e., consultants, actuaries, third party administrators attorneys and accountants), welfare plan sponsors and insurers, and investment managers.  

 

We offer representation in a wide array of ERISA disputes, including:

¨ Claims for breach of fiduciary duty

¨ Benefits claims by participants

¨ Review qualificed domestic relation orders

¨ Litigation on all aspects of compensation, retirement plan, and health and welfare plan issues

¨ Representation before the IRS Appeals Office and Department of Labor’s administrative law judges

The Firm also represents clients before the Internal Revenue Service (“IRS”) and U.S. Department of Labor (“DOL”), often assisting with respect to issues arising out of IRS audits or DOL investigations.  The Firm also has experience with correcting plan defects and breaches of fiduciary duty under the voluntary compliance programs offered by the IRS and the DOL. 

 

We recognize that litigation can be both costly and a drain on management time.  Therefore, we attempt to utilize negotiation, mediation and alternative dispute resolution techniques when appropriate.  We also work with clients to proactively minimize litigation exposure.
