Allison Martinez, née De Tal

Allison Martinez is an employee benefits and tax attorney who combines technical expertise with a genuine passion for helping others. With over a decade of experience in guiding employers through complex tax and benefits laws, she enjoys unraveling the “puzzle” of employee benefits law and delivering practical, client-focused solutions. Her practice covers a broad range of tax, retirement and health and welfare plan issues, including plan design and regulatory compliance.


Allison advises employers on maintaining tax-qualified status, HIPAA and COBRA compliance, ACA implementation, and resolving plan errors through IRS and DOL correction programs.  She helps employers navigate questions related to nonqualified deferred compensation plans. She has experience advising private employers, governmental entities, non-profit organizations, and religious organizations.

Earlier in her career, Allison served as a judicial law clerk to the Honorable Harry Haines and the Honorable Joel Gerber of the U.S. Tax Court.  Allison also has a tax controversy background – working with both individuals and large multi-national corporations.  

 

Allison is a dedicated contributor to the legal community and values giving back through meaningful pro bono service. She previously worked as a Staff Attorney at the Legal Aid Society of San Diego, has volunteered with legal aid clinics, and been an active member of her prior firms’ pro bono practices. Her efforts have earned her recognition on the Capitol Pro Bono Honor Roll and the distinction of being the Inland Empire Latino Lawyers Association’s Pro Bono Attorney of the Year. 

 

Whether advising on complex employee benefits issues or helping a client access critical health benefits, Allison is known for her thoughtful, compassionate approach and commitment to making a difference.
